How to protect yourself from blocking a bank account when operating with a crypt?

According to the recommendations of the Central Bank, banks should block cards interconnected with cryptocurrency exchangers. For whom are the new rules and how to protect yourself from problems with cryptocurrency transactions?

The Central Bank of the Russian Federation announced the algorithm for using payment cards and electronic wallets in the framework of transactions to the addresses of unofficial online casinos, forex dealers and crypto exchangers. The regulator strongly recommends that banking institutions block such accounts and cards.

Representatives of the Central Bank note that within the framework of an unofficial business, cards and electronic wallets can be issued to dummies, which most often happens. Such accounts are characterized by the absence of day-to-day operations, payments for utilities and other services. Instead, transactions are conducted here, which differ in frequency and amount.

Illegal business uses appropriate software to conduct such transactions. With its help, you are connected to online banking pages on which funds are transferred between cards. All information that is needed in such operations is filled in automatically.

In addition to blocking suspicious cards and wallets, the Central Bank instructed banking institutions to terminate the customer service agreement in case of two or more blockings in 1 year.

If two or more points fit a particular account, it will be categorized as "suspicious":

    increased number of individuals, over 10 people / day, 50 people / month;
    large volumes of transactions for debiting-crediting money between individuals (for example, over 100,000 rubles / day, 1,000,000 rubles / month);
    a small amount of time passes between transactions (for example, less than 1 minute);
    for 1 week, the average balance of money on the card, wallet for the period of the end of the operating day is below the mark of 10% of the average daily volume of transactions on this account for the corresponding time period;
    an increased number of transactions for debiting-crediting money carried out with individuals (over 30 transactions / day);
    lack of transactions with a card or wallet to pay for services, goods;
    the use of one device by different individuals in order to obtain remote access to the relevant services of the credit company;
    Carrying out transactions debiting-crediting funds for 12 hours or more.

Is it possible to block a crypto user account?

According to E. Kazantsev, a member of the Commission on the Legal Support of the Digital Economy of the Moscow Branch of the Association of Lawyers of the Russian Federation, the account is blocked by a banking institution if the above points are violated. In other words, if the user actively buys and sells crypto, it violates the available number of operations.

To unblock the account, you need to contact the bank to clarify the situation. According to Kazantsev, documents will be required that can confirm that no lawful actions were taken by the user.

It is worth understanding here that the use of a personal account in the framework of any type of activity is already illegal and is determined by the current legislation and directly by the Central Bank. To conduct entrepreneurial activity under the legislation of the Russian Federation, you must have a current account of an individual entrepreneur, a legal entity, an account of a self-employed citizen. Otherwise, the use of a personal account is considered illegal business.

How to protect yourself from being blocked?

The expert recommends observing the limits established by the Central Bank, abandoning actions on a personal card that may seem suspicious.

As noted by D. Kirillov, who is a lawyer and teacher at the Moscow Digital School, the legislation does not currently regulate activities related to cryptocurrency.

It should be noted that the recommendations are not binding on banks. The agency aims to urge banking institutions to more in-depth verification of suspicious cards and accounts for the use of illegal transactions. The expert also advises not to use the services that are listed in the statement of the Central Bank.
